Terms of Service

These Terms of Service govern use of the Picnjoy platform by the subscriber: the person or entity that creates an account, operates a workspace, and configures campaigns.

They do not replace the acceptances shown to participants (visitors) of each campaign. Experience terms and visitor selfie-processing consent are distinct from these Terms and appear when accessing the campaign.

Picnjoy is an AI image generation platform. Each subscriber operates a workspace where they create themes (including prompts and image model), campaigns, and operating rules.

A campaign defines associated themes, a validity period, access policy (public or private email list), per-member credit budget, link, and QR Code. The visitor accesses it in a mobile browser, signs in with a magic link, submits a selfie, and receives generated images. Generation only runs while the campaign is active and within the validity period.

The platform provides a participant gallery, feed and slideshow per campaign (only with visitor approval), and a metrics and moderation panel for the subscriber. It is not a social network or an on-site professional photography service.

Access is offered on Free (Basic) and Pro plans. The subscription unlocks capacity (for example, number of active campaigns and themes per campaign) and may grant periodic credits to the workspace balance. Subscription and credit-pack payments are processed via Stripe.

Each generation consumes workspace credits according to the AI model and the consumption table in force at capture time. Plan prices, packs, and credits per model may change; changes are communicated in the product or by official Picnjoy notice.

Subscription credits follow the billing cycle and do not accumulate indefinitely. Credits bought in packs follow the validity rules published in the product. If a generation fails permanently, credits may be returned to the balance. That credit return is not a cash refund.

You must use the platform lawfully, respecting third-party rights and applicable law, including Brazilian law. Illegal or offensive content, content that violates image or intellectual-property rights, or bad-faith attempts to bypass private lists, budgets, or access controls are prohibited.

In case of non-compliance, Picnjoy may warn, suspend, or terminate access to the account or specific campaigns, and archive or remove feed content.

Reports of misuse or inappropriate content may be sent to support@picnjoy.com. Picnjoy will review the report and may take proportionate measures, including moderation, suspension, and cooperation with authorities when required.

Visitor selfies and attachments are used only to generate campaign images and are deleted once generation finishes, fails permanently, or the participant leaves the flow. After that, the visitor's original images are not accessible: neither Picnjoy nor the campaign administrator can view or download them.

AI-generated images remain available in the participant gallery and, if approved, in the campaign feed, and may be archived by the administrator. Reference images included by the subscriber in themes are campaign assets. Account, payment, and workspace configuration data are kept to provide the service and meet legal obligations.

Picnjoy does not use visitor images to train AI models. Further detail is in the Privacy Policy.

We do not offer cash refunds for subscriptions or credit packs already paid, except where required by law.

You may cancel the subscription at any time. After cancellation, access to paid-plan benefits continues until the end of the period already paid; afterward there is no further charge and the account is downgraded to the Free (Basic) plan.

Unused credits are not refunded in cash or exported outside the platform. They must be consumed while valid under product rules (subscription-cycle credits expire with the period; purchased credits follow product validity).

Account deletion is done by the subscriber in the platform, after downgrade to Free, through the deletion flow available in the account.

Picnjoy is responsible for providing the infrastructure for the subscriber to create and operate campaigns, in compliance with applicable law and these Terms. We do not guarantee a minimum availability percentage or response time, unless a separate written contract sets different terms.

The subscriber is responsible for the content they configure and publish (themes, prompts, and brand assets), communication with participants, feed moderation in the panel (including archiving), and lawful campaign use by the public.

Picnjoy may intervene, upon report, legal obligation, or when needed for operations, to moderate, archive, or remove content that unduly discomforts others, violates these Terms or the law, and to suspend campaigns or accounts.

When accessing a campaign, participants accept the experience terms and selfie-processing consent presented by Picnjoy in the flow (including at the magic link and before the camera). Those acceptances are distinct from these subscriber Terms of Service.

The subscriber remains responsible for running the campaign appropriately and for guiding participants about the experience, in line with the Privacy Policy and the acceptances shown in the flow.

The Picnjoy brand, software, documentation, and platform interface belong to Picnjoy or its licensors. The subscriber retains rights in themes, prompts, and brand assets they upload, and warrants they are authorized to use them.

Generated images are used under campaign rules and participant acceptances. Publication on a public feed requires the visitor's explicit approval.

We may update these terms. The current version will always be on this page with the date of the last update. Continued use of the subscriber account after publication constitutes acceptance of the current version where permitted by applicable law.
